Welcome to Xcutlery. These Terms of Service ("Terms") govern your use of the websites xcutlery.com and xcutlery.com.au (together, the "Site") and your purchase of any products from us. By accessing the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. About Us

Xcutlery designs and sells hand-forged kitchen cutlery, including chef knives, cleavers, butcher knives, slicers, and knife sets. We ship from our warehouses in Memphis, Tennessee (United States) and Melbourne, Victoria (Australia).

2. Age Requirement

Our products are kitchen tools with sharp edges. You must be at least 18 years of age to purchase from this Site. By placing an order, you confirm that you are 18 or older and that you are legally permitted to purchase and possess kitchen knives in your jurisdiction. It is your responsibility to ensure compliance with the laws of your country, state, or territory regarding the purchase, import, and ownership of kitchen cutlery.

3. Intended Use

All Xcutlery products are designed, marketed, and sold exclusively as culinary tools for food preparation. Any other use is outside the intended purpose of the product, and Xcutlery accepts no responsibility for misuse. Knives are inherently sharp — handle, store, and maintain them with appropriate care and keep them away from children.

4. Products & Handmade Variations

Every Xcutlery blade is individually hand-forged. Variations in forge texture, hammer marks, finish, exact dimensions, weight, and wood grain are natural characteristics of handmade products and do not constitute defects. Product images are representative; your knife will be unique.

We reserve the right to modify, discontinue, or limit quantities of any product at any time without notice.

5. Pricing & Payment

  • All prices on xcutlery.com are in US Dollars (USD); prices on xcutlery.com.au are in Australian Dollars (AUD) unless stated otherwise.
  • Prices do not include applicable taxes, duties, or import fees for international orders, which are the customer's responsibility.
  • We accept the payment methods displayed at checkout. Payment is processed securely by third-party payment providers; we do not store your full card details.
  • We reserve the right to correct pricing errors, cancel orders affected by errors, and refuse or cancel any order at our discretion (including suspected fraud). If your order is cancelled after payment, you will receive a full refund.

6. Orders & Shipping

  • An order confirmation email does not constitute acceptance of your order; acceptance occurs when your order ships.
  • Shipping is free within the United States and Australia. International orders ship worldwide at the rates shown at checkout.
  • Delivery estimates are provided in good faith but are not guaranteed. We are not liable for delays caused by carriers, customs, or events outside our control.
  • Risk of loss passes to you upon delivery to the carrier, except where consumer law provides otherwise.
  • International customers are responsible for ensuring the products they order can be lawfully imported into their country. Orders seized or refused by customs due to local restrictions are not eligible for refund of shipping costs.

7. Returns, Refunds & Warranty

Returns, refunds, exchanges, and our lifetime warranty are governed by our [Return & Refund Policy], which forms part of these Terms. Please review it before ordering.

8. Intellectual Property

All content on the Site — including text, product names, designs, logos, images, and graphics — is the property of Xcutlery or its licensors and is protected by copyright, trademark, and other intellectual property laws. 9. Customer Reviews & Submitted Content

By submitting a review, photo, comment, or other content to the Site, you grant Xcutlery a non-exclusive, royalty-free, perpetual, worldwide license to use, display, and reproduce that content in connection with our business. You confirm your submissions are your own, accurate, and do not violate any third-party rights. We may remove any content at our discretion.

10. Prohibited Uses

You agree not to use the Site to: violate any law or regulation; infringe intellectual property rights; transmit malicious code; scrape, harvest, or collect data without permission; submit false or misleading information; interfere with the Site's security or operation; or place fraudulent orders.

11. Disclaimers

The Site and all products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties not expressly stated in these Terms or our Return & Refund Policy, including implied warranties of merchantability and fitness for a particular purpose. We do not warrant that the Site will be uninterrupted, error-free, or secure.

12. Limitation of Liability

To the fullest extent permitted by law, Xcutlery shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or products, including injury resulting from misuse, improper handling, or failure to follow care and safety guidance. Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including your rights under the Australian Consumer Law if you are a consumer in Australia.

13. Indemnification

You agree to indemnify and hold harmless Xcutlery, its owners, and employees from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of any product, or your violation of any law or third-party right.

14. Governing Law

For customers in the United States and internationally, these Terms are governed by the laws of the State of Tennessee, USA, without regard to conflict-of-law principles. For customers in Australia, these Terms are governed by the laws of Victoria, Australia, and nothing in these Terms limits your rights under the Australian Consumer Law.

15. Changes to These Terms

We may update these Terms at any time. The updated version will be posted on this page with a revised "Last updated" date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
